As of July 4, 2008, the "Choose Life" license plate has been approved in 18 states: Alabama, Arkansas, Connecticut, Florida, Georgia, Hawaii, Indiana, Kentucky, Louisiana, Maryland, Mississippi, Missouri, Montana, Ohio, Oklahoma, Pennsylvania, South Dakota, and Tennessee. Since the year 2000 when the "Choose Life" plate was first approved in Florida, over 400,000 plates have been purchased and renewed nationwide raising over $9 million for hundreds of pregnancy care centers, maternity homes, adoption agencies and safe haven efforts that provide the financial resources and moral support that desperate women so often need in order to courageously choose life and consider adoption for an unwanted pregnancy or an unwanted newborn.

Motorists in New York State can choose from over 300 different custom license plates approved under nine different categories: Causes & Organizations; Sports; NASCAR; Military & Veterans; Colleges & Universities; Sororities & Fraternities; Emergency Services; and Professions.

Specifically, the NYS DMV has approved dozens of custom plates for highly diverse organizations and causes that include political labor unions like the AFL-CIO and the New York Union of Teachers; religious organizations like the Knights of Columbus and the Ancient Order of Hibernians; and even controversial organizations including the Masons, the Prince Hall Masons and the NY Racing Association. There is even a New York "DONATE Life" plate to promote organ and tissue donations. Since 2002, however, the pro-adoption New York "CHOOSE Life" plate has been blocked.

In December 2001, The Children First Foundation (CFF), submitted its application for an organizational custom license plate in New York. The DMV rejected CFF's "Choose Life" plate (pictured above) calling it "patently offensive." CFF's attorneys challenged the DMV's decision in writing. Unfortunately, on August 2, 2004, the DMV refused to approve the "Choose Life" plate and issued a moratorium to block the approval of new organizational custom plates until further notice. Two days later, the Alliance Defense Fund (ADF) filed a federal lawsuit to defend CFF's constitutionally protected Freedom of Speech, Due Process and Equal Treatment under the Law. Thanks to ADF, over the past four years CFF has won four important federal court rulings, including a favorable ruling from the Second Circuit Court of Appeals in Manhattan in March, 2006.

Four months later, on July 27, 2006, Governor Pataki cited "legal concerns" and unexpectedly vetoed 15 legislatively-approved custom plates, including the 9/11 Remembrance Plate, the Cure Childhood Cancer Plate, the Veteran's Outreach Plate, the Survivor of the Bravest Plate (for the families of fallen firefighters), the Kiwanis International Plate and 10 other custom plates.

Under both Governor Spitzer and Governor Paterson, not a single new organizational or legislative custom plate has been approved with one notable exception. In February 2008, Governor Spitzer and the DMV immediately approved and issued a new custom plate to celebrate the NY Giants "Super Bowl" Championship.


New York State politicians and DMV officials must defend the civil liberties of all New Yorkers, not just those they personally or politically favor.
